In addition, you may be providing Axis’ technical support personnel with access to files that reside on your computer. Axis performance of any Support Services is not intended to, and shall not, create any legal relation whatsoever between you and/or your employer, as applicable, and Axis and/or any of Axis’ affiliates, including but not limited to any legal obligations for Axis and/or any of its affiliates against you and/or your employer. Axis and/or any of its affiliates’ obligations in relation to any Axis products purchased by you and/or your employer are subject exclusively to terms and conditions of agreement between Axis and the entity that purchased such products/components directly from Axis.
For the avoidance of doubt, Axis provides all SUPPORT Services “as is” without warranty of any kind (whether express or implied), including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, result, effort, title and non-infringement. The entire risk as to satisfactory quality, performance, ANY AND ALL LOSSES (including but not limited to loss of data), accuracy and results obtained with respect to the SUPPORT Services provided here under lies with you and/or your employer, as applicable. Consequently, Axis does not warrant that the SUPPORT Services will fulfil any of your and/or your employer’s, as applicable, particular purposes or needs. AXIS DISCLAIMS AND EXCLUDES, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL LIABILITY AND ALL WARRANTIES, WHETHER STATUTORY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT AND PRODUCT LIABILITY, OR ANY WARRANTY ARISING OUT OF OR IN CONNECTION WITH THE PROVISION OF SUPPORT Services.
